10-mark question · Part C · Law Relating to Women
X, a woman employee unable to give birth to a child by natural course, took the help of a surrogate mother. After completion of the gestation period the surrogate delivered the baby and handed over the child to X. Taking custody of the child, X applied for maternity leave to her employer. It was denied by the employer as she did not carry the baby in her womb and did not suffer the pains of delivery. Advise X. Note.
